ISDS – 私たちの未来に対する脅威

340以上の市民社会団体が、世界各国の政府に対し、あまり知られていない秘密裏の国際仲裁制度から「脱却」するための連合を構築するよう求める公開声明に署名しました。Global JusticeとNow European Trade Justice Coalitionによる報告です。

4月末にコロンビアで開催される脱化石燃料に関する第一回国際会議に先立って発表されたこの声明は、投資家対国家紛争解決（ISDS）制度として知られるこの制度が、「化石燃料からの公正な移行と、人々と地球のための社会・環境変革の緊急性を脅かしている」と述べています。

英国のGlobal Justice Nowのクレオディ・リカード氏は次のように述べています：

企業は、利益を損なう恐れのある法律や政策をめぐり、国内法制度の枠外で政府を訴えるために、こうした秘密裏に行われるISDS（投資家対国家紛争解決）裁判所を利用している。これは権利を侵害し、主権を制限する、極めて非民主的な制度である。化石燃料企業はISDSを徹底的に利用し、政府を脅迫して汚染燃料対策から撤退させている。そして、政府が対策に踏み切った場合でも、汚染企業はISDSを利用して納税者の負担で賠償金を得ようとし、移行コストを増大させている。”

タンザニア貿易投資連合（TATIC）のオリビア・コスタ氏は次のように述べています：

天然資源を規制し、有害な資源採掘から地域社会を守る権利は、秘密主義的な投資家対国家の仲裁裁判所によって決して侵害されてはならない。ISDSによる賠償金は巨額だ。発展途上国は、企業に支払うのではなく、気候変動対策、公衆衛生、社会正義など、公共の利益のために予算を組むことができるはずだ。”

コロンビア、Comité por la Defensa del Agua y Páramo de Santurbán（サントゥルバンの水とパラモ防衛委員会）のフアン・カミロ・サルミエント氏は次のように述べています：

ISDSは、多国籍企業が地球破壊を深刻化させ、免責を維持し、公的資金を略奪するための、まさにうってつけの仕組みだ。それは、土地、自然、そして生命を守るために立ち上がる人々に対する暴力行為を助長する。各国政府は地域社会と自然を守る義務を負っており、ISDSから離れるという同じ方向へ進み始めなければならない。”

Australian Fair Trade and Investment Network (AFTINET)（オーストラリア・フェアトレード＆投資ネットワーク）の代表であるパトリシア・ラナルド博士は次のように述べています：

各国政府はISDS協定から脱退している。オーストラリア政府は新規協定からISDSを除外し、既存協定においてISDSから撤回している。しかし、これは遅々として進まないプロセスであり、我々はオーストラリア政府に対し、他国と連携してISDS協定からの脱退に向けた政府間協調行動を検討するよう強く求める。”

インドネシアのトランスナショナル研究所のラフミ・ヘルタンティ氏は次のように述べています：

もう十分だ。ISDSがもたらす害悪については数十年の経験があり、結論は出ている。各国政府は団結し、ISDSからの脱却を目指す国々の連合を構築すべき時だ。各国はISDSに関する新たな協定の締結を停止し、既存の協定を破棄し、条約の集団的破棄を検討することを約束する必要がある。”

背景

ISDS条項は、多くの貿易・投資協定に盛り込まれています。この条項により、多国籍企業は、利益を損なう行為を行ったとして、特別仲裁裁判所で政府を提訴する権利を得ています。世界の化石燃料企業は、ISDS制度の最大の受益者であり、これまでに870億ドルを超える賠償金を受け取っています。

4月に開催される多国間気候変動フォーラムでは初めて、化石燃料からの段階的脱却を阻むISDS制度の障壁に対処する必要性が、議題の重要なテーマとして取り上げられます。これは、コロンビア大統領が最近、ISDS制度からの脱退を表明したことを受けてのことです。

European Trade Justice Coalitionからの署名声明

投資家対国家紛争解決（ISDS）は、化石燃料からの公正な移行、そして人々と地球のための社会・環境変革の喫緊の必要性を脅かしています。私たちは、このリスクが第1回化石燃料からの移行に関する会議のテーマ別柱に認識され、盛り込まれたことを歓迎します。

私たちは各国政府に対し、ISDSからの脱却を目指す国々の連合を構築するよう求めます。

ISDSメカニズムは、多くの貿易協定や投資協定に盛り込まれています。これにより、多国籍企業は、利益減少につながる恐れのある法律や政策変更について、国内法制度の枠外にある秘密の仲裁機関で政府を提訴する権利を得ています。ISDSは、外国投資家に、地元企業や一般市民、特に投資によって最も影響を受ける人々やコミュニティには与えられない特権を付与しています。

ISDSの影響は、医療や公共サービスから国家安全保障や化学物質安全規制に至るまで、社会と経済のあらゆる分野に及んでいます。これは、権利を侵害し、主権と民族自決権を制限する、極めて反民主主義的な制度です。

長年にわたり、石油・ガス・鉱業などの資源採掘企業やエネルギー企業は、各国に対して数百件もの投資家対国家紛争解決（ISDS）訴訟を起こしており、その数は増加の一途をたどっています。化石燃料・鉱業企業は、1998年以降、ISDSを利用して870億ドル以上の公的資金を獲得してきました。¹

さらに近年、化石燃料からの脱却に直接的に異議を唱える訴訟が増加しています。企業は、石炭火力発電の段階的廃止、新規炭鉱の認可拒否や既存炭鉱の拡張、エネルギー過剰利益に対する超過利潤税、海洋石油掘削の禁止、フラッキング規制、ガス田の閉鎖など、様々な問題で訴訟を起こしています。²

気候危機の最前線に立つ地域社会は、破壊的な採掘やその他の資源採掘プロジェクト、そして鉱物資源需要の高まりに対する闘争を通じて、ISDS（投資家対国家紛争解決）訴訟の中心となることが少なくありません。

化石燃料の段階的廃止と真に公正な移行にとって、ISDSがもたらす主なリスクは、汚染者への賠償金の法外な増加と、必要な法改正や政策変更への萎縮効果です。企業はISDSを通じて、国内裁判所よりもはるかに高額な（税納者からの）金額を請求できる場合が多々あります。最近の請求額は数十億ドルに達しており、多くの国の支払い能力を超え、公正な移行を支援する能力を損なっています。その結果、訴訟を恐れるあまり、各国は化石燃料やその他の採掘産業に関する必要な対策を遅らせたり、あるいは講じないことを決定したりする可能性があります。各国は既にこうした事態が起きていることを認めています。³

国連機関は、2022年のIPCC報告書や特別報告者の報告書を含め、ISDS（投資家対国家紛争解決）に関して根本的な懸念を表明しています。⁴ 国際司法裁判所は、投資協定は孤立して解釈されるべきではなく、国際的な気候変動法と調和して解釈されるべきであり、各国は気候変動とその結果として生じる被害を防止、緩和、是正する義務を複数の国際法源に基づいて負っていることを強調しています。⁵ COP29およびCOP30議長国によるバクー・トゥ・ベレン・ロードマップは、ISDSを制度的な障壁として特定しています。⁶

私たちは各国政府に対し、あらゆる形態のISDSから解放されることを約束する政府連合の構築を開始するよう求めます。⁷ この連合は、以下の点を検討します：

• ISDS（投資家対国家紛争解決）に関する条約を破棄するか、関係国政府間でISDSを撤廃するための再交渉を行い、「サンセット条項」に対処する
• ISDSからの脱却に向けたさらなる可能性を支援するため、他国との連携を図る
• 新たなISDS協定には一切署名しないことを約束する
• 将来の化石燃料条約にISDS撤廃に関する条項を盛り込む
• ISDSのない世界を実現するための多国間条約の交渉を開始する
